Privacy Policy

Apothes Group, LLC (“Apothes Group,” “we,” “us”) is a holding company based in Richmond, Texas. We own and operate a group of operating companies and provide shared services to them, including the software they run on. This policy explains what personal information we collect, how we use and share it, and the choices you have. It covers apothesgroup.com, the business systems Apothes Group operates for itself and its companies, and our text message and email communications (together, the “Services”).

Our operating companies may publish their own privacy policies for their own websites, apps, and customers. Where they do, that policy governs your relationship with that business.

1. Information we collect

Information you give us. When you contact us, subscribe to our emails, or are granted access to one of our systems, we may collect your name, email address, phone number, company, role, and the content of your messages. When you opt in to text message alerts, we collect your mobile number and a record of your consent.

Information collected automatically. When you visit apothesgroup.com, our hosting providers record standard server logs, such as IP address, browser and device type, pages requested, referring page, and the date and time of the request. The public website does not use advertising cookies or third-party analytics. Our private systems use essential cookies to keep authorized users signed in and secure.

Information from connected business systems. The software we operate for our companies connects to services those companies already use, such as booking and point-of-sale, staff scheduling, and accounting platforms, to produce each company’s own management reporting. Depending on the connection, this may include guest names and contact details the business already holds, booking and transaction records, staff schedules, hours and pay rates, and financial reports. Our access to accounting data is read-only, and we never write to a company’s books.

2. How we use information

• To operate, maintain, secure, and improve the Services.
• To respond to your inquiries and communicate with you.
• To send the text message alerts and emails you have asked to receive.
• To produce management, operational, and financial reporting for our companies.
• To detect, prevent, and investigate fraud, abuse, security incidents, and other harmful activity.
• To comply with law, enforce our terms, and protect our rights and the rights of others.

3. Text messaging (SMS)

Program. Apothes Cue Alerts are operational system alerts for Cue, the venue management software Apothes Group runs for its own venues. They tell authorized Apothes Group personnel when a system component goes down or recovers, for example a kitchen display going offline, a failed scheduled job, or a site becoming unreachable. We do not send marketing or promotional text messages, and we do not send text messages to customers through this program.

How you opt in. Alerts are sent only to personnel who sign in to our private Cue operations dashboard, enter a mobile number, and check a consent box that reads: “I agree to receive Cue system alert text messages from Apothes Group, LLC at this number. Message frequency varies. Message and data rates may apply. Reply STOP to opt out, HELP for help.” Consent is never a condition of employment or of any purchase.

What we collect. Your mobile number, the date and time of your consent, the account that gave it, the consent language shown, delivery records for the messages we send, and any STOP or HELP replies.

How we use it. Only to deliver the alerts you signed up for, to honor opt-out and help requests, and to keep the records needed to show that consent was given.

No sharing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. The categories of sharing described elsewhere in this policy exclude this information. Your mobile number and message content are processed only by the providers that transmit the messages for us, such as our messaging platform provider and wireless carriers, and only for the purpose of delivering those messages.

Opting out and help. Reply STOP to any message to stop receiving alerts. You will receive one confirmation message and no further alerts unless you opt in again. Reply HELP for help, or contact us at john@apothesgroup.com. Message frequency varies with system events. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Full program terms are in our Terms of Use.

4. Email communications

We send marketing email only to people who have given us their email address and agreed to hear from us, or where the law otherwise permits it. Every marketing email identifies Apothes Group as the sender, includes our postal address, and includes a working unsubscribe link. We honor unsubscribe requests promptly and in any event within 10 business days.

If you unsubscribe from marketing email, we may still send messages related to an account, a transaction, a service you use, or a legal notice. Our email providers may use standard technologies, such as tracking pixels and tracked links, to tell us whether an email was delivered, opened, or clicked, so we can measure and improve our communications. We never sell or rent our email lists.

5. How we share information

We do not sell personal information, and we do not share it for targeted advertising. We share it only as follows:

• Within Apothes Group. With the companies Apothes Group owns or operates, where needed to run and support those businesses, subject to Section 3.
• Service providers. With vendors that host, secure, and operate the Services for us, such as cloud hosting, email delivery, and messaging providers. They may use the information only to perform services for us and must protect it.
• Legal and safety. When required by law, subpoena, or court order, or when we believe disclosure is necessary to protect the rights, property, or safety of Apothes Group, our companies, our people, or others.
• Business transfers. In connection with a merger, acquisition, financing, reorganization, or sale of all or part of a business, subject to this policy.
• With your consent. Where you have asked or agreed that we share it.

We do not use personal information from connected business systems for advertising, and we do not use it to train machine-learning models.

6. How we protect information

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, encryption of stored credentials for connected services, role-based access limited to people who need it, and audit logging of access and permission changes. No system is perfectly secure, and we cannot guarantee the security of information transmitted to or stored by us.

7. How long we keep information

We keep personal information for as long as needed for the purposes described in this policy, including to provide the Services, maintain business and consent records, resolve disputes, and meet legal, tax, and accounting obligations. When a connection to a business system is removed, we stop collecting data from it. When information is no longer needed, we delete or de-identify it.

8. Your choices and rights

You can opt out of text alerts by replying STOP, and out of marketing email by using the unsubscribe link in any marketing email. Depending on where you live, you may also have the right to request access to, correction of, deletion of, or a copy of your personal information, and to appeal our decision on a request. To make a request, contact us at john@apothesgroup.com. We will verify your request and respond within the time required by applicable law. We will not discriminate against you for exercising these rights.

If you are a guest of a business we operate, that business holds your information. You can make a request through that business or through us.

9. Children

The Services are not directed to children under 13, and we do not knowingly collect personal information from them through the Services. If you believe a child has given us personal information, contact us and we will delete it.

10. Changes to this policy

We may update this policy from time to time. When we do, we will change the “last updated” date above, and where the changes are material we will take reasonable steps to let affected users know. Your continued use of the Services after an update means the updated policy applies.
